GENERAL CONDITIONS OF SALE

The following rules apply for tours purchased from PARS TOURIST AGENCY.

For purchase through a travel agent or tour operator outside Iran the actual agreement is between the customer and that agent tour operator.

In that case the same conditions apply but regulated under the conditions of the agent or operator and the travel guarantee system and consumer protection of the particular country is applicable.

1. Tour Operator

PARS TOURIST AGENCY (hereinafter referred to as PTA), Zand Ave, 71358 Shiraz , Islamic Republic of Iran is the liable tour operator. The company is a member of The American Society of Travel Agents (ASTA, www.astanet.com).

2. Booking

Booking takes place written directly to PTA. Bookings are finally confirmed when the balance has been paid (see ”payment”) and when you have received a final written confirmation/voucher by PTA. From this moment on a proper travel agreement exists between the parties.

3. Payment

Approximately 60 days before the tour, PTA issues an invoice for the total balance, which must be paid 6 weeks before the departure date. Especially flight tickets will not be issued before PTA has received payment for the services ordered by you. International flight tickets ordered via PTA will be sent to you before departure from your home country while tickets for domestic flights within Iran will be handed over to you right after arrival to Iran .

4. Cancellation by the customer

Cancellation must be done written. Dependent on when we receive notice of cancellation, we will refund the price of the tour minus the following percentage of the price to cover our losses in connection with the cancellation fee:

48 days or more prior to departure   5%
47-28 days  10%
27-20 days  15%
19-14 days 25%
13- 2  days 75%
1 day or less  100%

We recommend the customer to take out cancellation insurance.

5. Liability

PTA is the liable tour operator. The company acts on behalf of shipping companies, airlines and hotels/guest houses etc. included in the tour arrangements and is not liable for circumstances affecting the above companies etc., or for delays or losses, damage or costs incurred by circumstances beyond our control.

We also reserve the right to make changes to the itinerary (both before and after booking has been confirmed) with the customer’s safety and comfort in mind. Changes may also be made in order to provide assistance to e.g. groups or stranded persons. Providing assistance in this way is normal in areas such as these (e.g. during a trekking in mountainous areas), and shall be regarded as a part of the journey insofar as the occurence cannot be said to have adversely affected the journey in general to a significant degree.

Different conditions can lead to delays for flights and ships. Weather conditions can lead to difficult supply conditions and limited availability of services.

6. Customer’s obligations

The customer must adhere to regulations concerning conduct and guidelines given by the PTA. PTA reserves the right to refuse admittance to a trip if the customer is considered a safety liability, or if the customer behaves in such a way that he/she is of nuisance to the other participants on the trip.

7. Changes in price

We reserve the right to change the prices without prior notice. The price of the tour can only be changed up to 20 days before departure after a confirmed booking. This may be necessary due to unforeseen changes in duties, taxes or transport costs. Should a price increase of this nature be in excess of 10% of the price of the tour, the customer is entitled to cancel the arrangements with full compensation.

8. Cancellation

PTA reserves the right to cancel any departure due to insufficient bookings up to 4 weeks due to majeure force or other circumstances beyond the control of PTA which prevent the customer taking the tour.

9. Insurances

PTA has taken out liability insurance. We also have lodged a bond with the local Iranian authorities for any costs associated with rescue operations. The customer should have an ordinary travel health insurance  in order to take part in the trip, and this may be purchased in travel agents or from insurance companies. A confirmation about the travel insurance must be presented to PTA before departure.

10. Legal settlements

The buyer accepts Shiraz City Court as legal venue. Any dispute between the buyer and PTA is to be settled by an Iranian Court . Disputes with regards to missing payment will be handed over and presented for international collection to a Swiss partner company.

11. Printing errors

No liability is accepted for printing errors in programmes, descriptions and brochures.
